Please read these Terms of Service carefully before using IdentiMind. By accessing or using our service you agree to be bound by these Terms. If you do not agree, please do not use the service.
1. Who We Are
IdentiMind is a professional cognitive thinking assessment service operated by Phyner Ltd, a company registered in England and Wales under company number 13008071.
In these Terms, “IdentiMind”, “we”, “us”, and “our” refer to Phyner Ltd. “You” and “your” refer to the individual accessing or using the service.
Our registered address is: 93 Springfield Drive, Ilford, Essex, IG2 6QS, UK.
2. Acceptance of Terms
By accessing identimind.com (the “Site”), completing the assessment, or purchasing a premium report, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy.
If you are using IdentiMind on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
3. Eligibility
You must be at least 16 years of age to use IdentiMind. By using the service, you represent that you meet this requirement.
If you are between 16 and 18 years old, you should review these Terms with a parent or guardian before proceeding.
IdentiMind is intended for personal and professional self-development purposes. Use of the service for any automated, bulk, or commercial resale purpose without our express written consent is prohibited.
4. The Service & Digital Products
IdentiMind provides an online cognitive thinking assessment that generates a personalised report describing your thinking preferences across four dimensions. The service includes:
- A free assessment and partial results summary available to all users
- A paid premium report (“Premium Report”) available upon one-time payment
- Access to a downloadable PDF version of your premium report
The Premium Report is a digital product delivered immediately upon successful payment. It is generated specifically from your own assessment responses and is unique to you. Delivery is complete at the moment the report is made available in your browser session.
We reserve the right to modify, suspend, or discontinue any part of the service at any time. Where changes materially affect a purchased product, we will make reasonable efforts to notify affected users.
5. Assessment Disclaimer
The IdentiMind assessment measures self-reported thinking preferences — the cognitive styles you naturally gravitate toward in work and professional situations. It does not measure intelligence, aptitude, skill, or fixed personality traits.
Your results reflect how you completed the assessment at the time of taking it. Thinking preferences can shift with experience, role, or context. IdentiMind does not claim that your results are permanent, predictive, or deterministic.
The accuracy of your results depends on the honesty and care with which you complete the assessment. We cannot guarantee that results will reflect your thinking preferences if the assessment is completed carelessly, dishonestly, or while significantly fatigued or distressed.
Results should be interpreted as a developmental tool, not a definitive or authoritative characterisation of who you are.
6. No Professional Advice
IdentiMind does not provide medical, psychological, psychiatric, therapeutic, or clinical advice, diagnosis, or treatment.
The IdentiMind assessment is a professional development and self-awareness tool. It is not a clinical instrument, a validated psychological test, or a substitute for evaluation by a qualified mental health or medical professional.
Nothing in your IdentiMind report should be construed as a mental health assessment, psychiatric evaluation, or medical opinion. If you have concerns about your mental health or cognitive functioning, please consult a qualified healthcare professional.
IdentiMind is a development and self-awareness tool. It is not a selection, screening, or eligibility instrument, and it has not been validated as one. IdentiMind reports must not be used as a basis — whether sole or contributing — for hiring, firing, promotion, compensation, clinical assessment, or any other determination that could significantly affect an individual's rights, employment, or opportunities. Any organisation that uses IdentiMind does so on its own responsibility and remains solely responsible for compliance with all applicable employment and anti-discrimination law.
7. Intellectual Property
All content on IdentiMind — including but not limited to the assessment methodology, item bank, scoring system, report content, written descriptions, design elements, software, and the IdentiMind Framework — is the original intellectual property of Phyner Ltd and is protected by copyright and other applicable laws.
“IdentiMind” and “IdentiMind Framework” are original works of Phyner Ltd. Unauthorised use of these names or associated materials is prohibited.
Upon purchase, you are granted a personal, non-transferable, non-exclusive licence to access and use your Premium Report for your own personal and professional development purposes. This licence does not permit:
- Reproducing, distributing, or republishing any part of the report or assessment
- Using any part of the service in a competing product or service
- Reverse engineering the assessment methodology or scoring system
- Sharing your report with third parties for commercial purposes
You may share your report with employers, coaches, or colleagues for personal development purposes. You may not resell or sublicence it.
8. Acceptable Use
You agree not to use IdentiMind to:
- Violate any applicable law or regulation
- Impersonate another person or complete the assessment on behalf of someone else without their knowledge
- Attempt to access, scrape, or extract assessment content, items, or scoring logic through automated means
- Circumvent, disable, or interfere with security-related features of the site
- Transmit any harmful, offensive, or disruptive content
- Use the service to develop competing assessment products or services
- Resell, redistribute, or commercially exploit assessment results or report content
- Attempt to gain unauthorised access to any part of the system
We reserve the right to terminate or restrict access to any user who violates these conditions, without notice and without refund.
9. Payments & Pricing
The Premium Report is available for a one-time payment of USD $29 (or the equivalent in your local currency where applicable). All prices are displayed inclusive of any applicable taxes unless otherwise stated.
Payments are processed by our authorised payment processors. Depending on your location and chosen payment method, your transaction may be processed by Paddle.com Market Limited or Paddle.com Inc.(“Paddle”), who act as the Merchant of Record for applicable transactions. Where Paddle is the Merchant of Record, your purchase contract is with Paddle, and their terms apply to the payment transaction.
Additional payment methods including card payments via Stripe and PayPal may be available. By completing a purchase, you agree to the terms of the applicable payment processor.
All sales are in USD unless otherwise indicated. Currency conversion charges, if any, are the responsibility of your bank or card issuer.
10. No Subscription
IdentiMind operates on a one-time payment model. There is no recurring subscription, automatic renewal, or ongoing charge associated with the individual Premium Report purchase.
Your access to your Premium Report is available for the duration of your browser session following purchase, or for as long as you retain your access token. We do not operate user accounts and are not responsible for access lost due to clearing browser data.
Enterprise and team arrangements may have separate payment terms agreed in writing.
11. Refunds
Our refund policy is set out in our Refund Policy, which forms part of these Terms.
In summary: because the Premium Report is a personalised digital product delivered immediately upon payment, refunds are generally not available once the report has been generated and accessed. Exceptions apply for duplicate charges, payment errors, and technical failures that prevent report delivery. Please see the Refund Policy for full details and how to request a refund.
12. Privacy
Your privacy matters to us. Our Privacy Policy explains what information we collect, how we use it, and your rights in relation to it. The Privacy Policy is incorporated into these Terms by reference.
IdentiMind is designed to be minimally invasive: we do not require account creation, and your assessment responses are processed locally and used only to generate your report. We do not sell personal data to third parties.
13. Disclaimer of Warranties
IdentiMind is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or completely secure. We do not warrant that the results of using the service will be accurate, reliable, or meet your specific requirements.
Some jurisdictions do not permit the exclusion of certain warranties. In such cases, the exclusions above apply to the fullest extent permitted by applicable law.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Phyner Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of IdentiMind.
Our total liability to you for any claim arising from or related to these Terms or your use of the service shall not exceed the amount you paid to us in the twelve months preceding the claim, or USD $29, whichever is greater.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any liability that cannot be excluded by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Phyner Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your use of IdentiMind in violation of these Terms
- Your violation of any applicable law or the rights of any third party
- Any content you submit or transmit through the service
16. Third-Party Services
IdentiMind uses third-party services to deliver and support the platform, including:
- Paddle — payment processing and merchant of record services (paddle.com)
- Stripe — payment processing (stripe.com)
- PayPal — payment processing (paypal.com)
These services are governed by their own terms and privacy policies. We are not responsible for the practices of these third parties. By using IdentiMind, you acknowledge that transactions may be subject to the terms of the applicable payment processor.
The Site may contain links to external websites. We are not responsible for the content, accuracy, or practices of any linked external site.
17. Changes to Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of IdentiMind after changes are posted constitutes your acceptance of the revised Terms.
If changes are material, we will make reasonable efforts to notify users — for example, by posting a notice on the site.
18. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or your use of IdentiMind shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in this clause affects your mandatory statutory rights as a consumer, including any right to bring proceedings in the courts of your country of residence where applicable law so provides.
